Rule of law should guide Committee reviewing petitions against Chief Justice - GBA

The Ghana Bar Association (GBA) has made a statement. They urged the Committee reviewing petitions against the Chief Justice to follow the Rule of Law.

The GBA emphasized that all involved should remember Article 296 of the 1992 Constitution. This article guides how discretion should be exercised. It is important to protect the independence and image of the Judiciary.

A joint statement was issued in Accra by Mrs. Efua Ghartey and Kwaku Gyau Baffour, GBA leaders. The GBA recognizes the constitutional process for removing the Chief Justice under Article 146 (6) to (10). They also noted that this matter is currently sub judice.

Over the past two months, the General Council of the GBA has monitored developments regarding this issue. This includes the Chief Justice's suspension by the President.

On March 27, 2025, during a General Council meeting, three petitions were submitted for her removal. Additionally, two cases were filed at the Supreme Court challenging this removal process. There have also been applications for an injunction against it.

The GBA is aware of Articles 146 (6) and (7), which outline how to remove a Chief Justice. They noted Articles 146 (8), (9), and (10) state that Committee meetings will be private. The President can suspend the Chief Justice based on advice from the Council of State.

The GBA aims to defend and enhance confidence in Ghana's justice system. They will act as society's conscience and voice for those without one. Their goal is to uphold the Rule of Law and support Ghana's Constitution.

According to their Constitution, Code of Ethics, and Regulations, GBA focuses on issues affecting the Legal Profession.
