MP goes to SC …challenges action to remove CJ - Ghanaian Times

Vincent Ekow Assafuah, the MP for Old Tafo, has filed a suit at the Supreme Court. He is challenging the constitutionality of a petition to remove Chief Justice Gertrude Araba Sackey Torkonoo.

Assafuah argues that President John Dramani Mahama must notify the Chief Justice about this petition. The President received the petition from three Ghanaians and sent it to the Council of State for advice. According to Assafuah, he should have obtained her response before doing so.

The MP has included Attorney-General Dr. Dominic Akurutinga Ayine in the suit as a defendant. Ayine is the government's main legal advisor.

Assafuah is asking the Supreme Court for a declaration on this matter. He believes that articles 146(1), (2), (4), (6) and (7), 23, 57(3), and 296 of the Constitution require notification to the Chief Justice before any action is taken regarding her removal.
