Justice Alexander Osei Tutu of the Court of Appeal has stated that for a marriage to be legally valid, it must be consummated through sexual intercourse.
He clarified that even if a couple completes all legal and ceremonial steps, the marriage is not considered complete without this physical aspect.
If a marriage isn't consummated, it is deemed legally non-existent, leading to an annulment rather than a divorce.
Justice Tutu's comments highlight that consummation is a crucial element for a marriage to be recognized by the law.
