The Achimota District Court, led by His Worship Prince Osei Owusu, has made a significant ruling. The court granted a motion from Karen Baaba Sam's lawyers. They argued that an arrest warrant against her was obtained illegally. This warrant was issued by her ex-partner, Nana Kwadwo Adjei, with help from some police officers.
During the hearing on February 4, 2025, Baaba Sam’s legal team stated the warrant lacked valid grounds. The State's representative, Senior State Attorney David Beecham, did not oppose this motion. As a result, the magistrate set aside the arrest warrant.
Now, Karen Baaba Sam is no longer at risk of arrest. She can continue her daily activities without fear. The arrest warrant had been dated January 20, 2025. It gained attention online as it claimed she was wanted for questioning about unlawful child removal.
The warrant included personal details about Baaba Sam such as her age and appearance. In an affidavit, she challenged its validity. She claimed it was based on fraudulent information and misleading statements.
Baaba Sam accused Detective Inspector Samuel Sakyi of fabricating claims about her daughter. She denied taking her daughter and refusing to return her. There are ongoing domestic abuse and custody cases between Baaba Sam and Nana Kwadwo Adjei.
The Circuit Court has issued interim protection orders for both Baaba Sam and her daughter. She also stated that the arrest warrant was issued without proper notification to her. Furthermore, she accused the complainant of bribing law enforcement officials.
Baaba Sam emphasized that the warrant caused her significant harm and distress. She requested justice for those responsible for issuing it wrongfully. With the warrant voided, she retains legal custody of her daughter under an existing protection order.
This ruling marks a significant turn in their ongoing legal dispute. Attention now shifts to addressing alleged misconduct within the Ghana Police Service regarding this case.
