Acting within the constitution is not wrong – Kwakye Ofosu defends Mahama over CJ suspension

Minister of State Felix Kwakye Ofosu defended President John Dramani Mahama's suspension of Chief Justice Gertrude Torkornoo. He called it a constitutional obligation, not a controversial action.

Kwakye Ofosu stated, “I’m not sure how abiding by the Constitution becomes a bad precedent.” He emphasized that President Mahama took an oath to uphold the 1992 Constitution.

He added, “That is what he has done in this instance.” He questioned how anyone could view constitutional actions as negative.

The suspension followed three petitions calling for the Chief Justice's removal. A prima facie case was established from these petitions.

According to Article 146(6) of the Constitution, the President consulted with the Council of State before suspending Justice Torkornoo. Formal investigative proceedings were also initiated.

A five-member committee has been formed to examine the allegations. This follows the required constitutional procedure.

Kwakye Ofosu clarified that the President’s action does not imply guilt. It reflects the legal process needed for serious petitions.

He stressed that this constitutional pathway ensures fairness and transparency. It also guarantees due process for everyone involved, including the Chief Justice.
