Private legal practitioner Alex Gyamfi has raised concerns about the rules for removing Ghana’s Chief Justice. He argues that these rules expose the office to political manipulation.
On The Forum on Asaase Radio, Gyamfi discussed Article 146. He questioned why it is easy to remove the Chief Justice but difficult to remove other Justices of the Superior Courts.
He warned that this setup makes the Chief Justice vulnerable, especially during politically charged times.
Gyamfi said, “It makes the Chief Justice so vulnerable. Anyone seeking political gain could easily attack them.” He urged a review of this issue now that a Constitutional Review Committee has been established.
He also addressed a recent controversy regarding a petition for the Chief Justice's removal. Gyamfi questioned how the government handled this process.
“Did the President willingly give a copy of the petition to the Chief Justice? The Chief Justice demanded it,” he stated. He added, “Who made this issue public? It was the same government that did.”
