Justice Abdulai, a private legal practitioner and member of the Ghana Bar Association (GBA), supports President John Dramani Mahama's decision to suspend Chief Justice Gertrude Torkornoo. He believes the suspension is constitutionally justified and follows proper legal procedures.
His comments respond to a resolution from the GBA. The GBA called the suspension unconstitutional and lacking legal basis under the 1992 Constitution. They demanded its immediate revocation.
On The Big Issue, aired on Channel One TV on Saturday, May 3, Justice Abdulai rejected the GBA’s stance. He disagreed with their resolution and questioned its legal foundation.
He stated that both the president and the Council of State acted lawfully. They considered all relevant responses, including those from the Chief Justice.
Justice Abdulai noted that typically, a Chief Justice's response does not influence whether a prima facie case exists. However, in this case, he said it was taken into account by both the president and Council of State. This led them to determine that a prima facie case had indeed been established.
