The Accra High Court is set to hear a judicial review filed by Samuel Aboagye, the declared winner of the Obuasi East parliamentary election, contesting the Electoral Commission’s (EC) second collation and declaration of results.
Aboagye, through his lawyer Elikplim L. Agbemava, seeks to nullify the EC’s December 21 declaration and compel the Commission to gazette the original results from December 8, which he claims named him the winner.
He also requests an injunction preventing the EC from publishing altered results and restraining Patrick Boakye Yiadom from presenting himself as the elected MP.
Aboagye argues that C.I. 127 prohibits a second collation after official results are announced and asserts that Form 1D, signed by all parties, is legally binding.
The case will be heard tomorrow at the General Jurisdiction Court Two.
