Professor Stephen Kwaku Asare has warned Ghana's Electoral Commission (EC) against its plan to classify votes for the late Akua Donkor, the Ghana Freedom Party’s presidential candidate, as rejected ballots in the upcoming December 2024 elections.
He argues that such a move, without amending existing laws or seeking judicial clarification, is unconstitutional and could undermine Ghana’s democratic framework.
Prof. Asare emphasized that Regulation 40 of C.I. 127 does not consider votes for a deceased candidate grounds for rejection, and any unilateral decision by the EC could affect the majority threshold required for election, potentially altering outcomes in close races.
He called for either legislative amendments or judicial interpretation to address such scenarios, warning that unilateral actions risk legal challenges and erode public trust in the electoral process.
