The Ghana Bar Association (GBA) is criticizing President John Dramani Mahama. They oppose his suspension of Chief Justice Gertrude Torkornoo. Saviour Kudze, the GBA's Public Relations Officer, calls the action unconstitutional. He argues there is no legal backing for this presidential discretion.
Kudze spoke on Citi Eyewitness News on April 29. He emphasized that Article 296 of the 1992 Constitution requires regulations for discretionary powers. These regulations prevent abuse and ensure transparency in governance.
He explained that regulations should be established before exercising discretion. This ensures proper governance and prevents misuse of power. During a meeting on April 26, GBA members agreed the President acted unconstitutionally.
Kudze stated that without these regulations, the President's actions were inappropriate. The GBA issued a statement on April 26 calling for the Chief Justice’s suspension to be reversed. They noted that while Article 146(10) allows presidential discretion, it must follow clear regulations for fairness and legality.
