Godwin Edudzi Tameklo is the Director of Legal Affairs for the NDC. He stressed that all proceedings to remove superior court justices must be private. He warned against setting a dangerous precedent by holding these matters in open court.
Tameklo shared his views on Facebook about judicial accountability. He referenced Article 146(8) of the 1992 Constitution. This article requires that investigations into judges' misconduct must be held in camera.
He explained that only the President can remove a Chief Justice or superior court justice. This action must follow recommendations from a committee investigating a formal petition.
Tameklo emphasized that closed-door proceedings protect the dignity and independence of the judiciary. He quoted Justice Kpegah's opinion from the Ghana Bar Association v Attorney-General case. He stated it would be detrimental if judges were removed in open court, violating constitutional provisions.
He cautioned that public litigation aimed at removing judges threatens judicial independence. This trend could erode public confidence in the judiciary's integrity.
