Petition for CJ’s removal shouldn’t have been publicised – Sam Okudzeto

Former Ghana Bar Association (GBA) President, Sam Okudzeto, has expressed disapproval over the publicizing of petitions seeking the removal of Chief Justice Gertrude Torkonoo.

Speaking on Joy FM’s Top Story on March 27, Okudzeto argued that such petitions should remain confidential until a prima facie case is established. He recalled that during his tenure on the Council of State, it was deemed improper to make such matters public before a decision was reached.

His comments follow President Mahama’s move to consult the Council of State after receiving three petitions calling for the Chief Justice’s removal. Government Communications Minister Felix Kwakye Ofosu confirmed that the petitions have been submitted in accordance with Article 146 of the 1992 Constitution.

Meanwhile, two lawsuits have been filed at the Supreme Court challenging the procedure, while the Chief Justice has formally requested copies of the petitions.

Okudzeto questioned the legal and procedural soundness of proceeding without the Chief Justice’s response, stating that beyond legal considerations, common sense dictates that her input is essential for a fair decision.
