Supreme Court Strikes Out Torkornoo’s Affidavit Over Confidentiality Breach

The Supreme Court has dismissed a supplementary affidavit from suspended Chief Justice Gertrude Torkornoo. The court ruled that it violated constitutional rules on confidentiality in judicial removal cases.

Torkornoo's affidavit supported her request for an injunction against her impeachment. She described the proceedings as a “mockery of justice” and a “ruse” to remove her unfairly. The affidavit also claimed she faced inhumane treatment and dignity violations.

A five-member panel found that the affidavit revealed details from the special committee investigating her removal. According to Article 146(8) of the Constitution, these proceedings must be held in camera.

Deputy Attorney General Justice Srem Sai raised objections to the affidavit. He argued it breached confidentiality requirements, stating, “The contents violate Article 146(8) by exposing private process details.”

Former Attorney General Godfred Yeboah Dame represented Torkornoo. He argued that the affidavit was part of judicial proceedings and not public, suggesting no constitutional violation occurred.

Despite this argument, the court agreed with the Deputy Attorney General. They concluded that the affidavit undermined privacy and confidentiality requirements. Consequently, they officially struck out the affidavit.
