The Supreme Court is set to hear a case on Wednesday, April 9, regarding the procedure for potentially removing Chief Justice Gertrude Torkornoo.
The case was filed by Old Tafo MP, Vincent Ekow Assafuah, who argues that President John Mahama’s move to consult the Council of State without informing the Chief Justice or giving her a chance to respond to allegations against her violates Article 146(6) of the Constitution.
Assafuah, represented by former Attorney-General Godfred Dame, asserts that this approach undermines judicial independence and breaches the constitutional framework.
The outcome of the case could establish the legal steps required before initiating any process to remove a sitting Chief Justice.
