Supreme Court to hear injunction application against processes to remove CJ on April 2nd

The Supreme Court has scheduled April 2, 2025, to hear an injunction application filed by New Patriotic Party (NPP) MP for Old Tafo, Vincent Assafuah, challenging the procedure being used by President John Mahama in handling petitions for the removal of Chief Justice Gertrude Torkornoo.

Assafuah, represented by former Attorney-General Godfred Dame, argues that the Chief Justice must be notified and allowed to respond before the President consults the Council of State.

The suit follows the President’s decision to forward three petitions to the Council of State in line with Article 146 of the 1992 Constitution.

Meanwhile, Chief Justice Torkornoo has written to the President requesting copies of the petitions and a fair opportunity to respond before further steps are taken. She urged that her response be considered in consultations before a possible inquiry committee is established.

Assafuah is seeking several declarations from the Supreme Court, including a ruling that failure to notify the Chief Justice before initiating consultations with the Council of State violates constitutional provisions on judicial independence and fair hearing.

The outcome of the case could have significant implications for Ghana’s judiciary and the ongoing legal debate over the removal process of a Chief Justice.
