The National Democratic Congress (NDC) has filed a lawsuit to prevent the Electoral Commission (EC) from re-collating and redeclaring parliamentary results for Dome-Kwabenya, Okaikwei Central, Ablekuma North, Tema Central, and Obuasi East constituencies.

The NDC argues that the EC, having declared the results, is now “functus officio” and lacks authority to revisit the process. They maintain that only the High Court, under Article 99 of Ghana’s Constitution, can invalidate declared results.

This follows the EC’s earlier declaration of results for some constituencies as invalid, citing procedural irregularities under CI 127.

Despite police presence to ensure a re-collation process, tensions have escalated.

Applicants in the case, including Faustina Akurugu and Baba Sadiq, are seeking a court order to bar the EC from taking further action on the disputed results.
