Former Attorney General Martin Amidu has sharply criticized the Supreme Court's November 12, 2024, ruling that deemed Speaker Alban Bagbin’s declaration of four parliamentary seats vacant as unconstitutional.
In a detailed analysis, Amidu described the ruling, cited by Majority Leader Alexander Afenyo-Markin in a memorandum, as a “per incuriam judgment,” arguing it disregarded constitutional and procedural requirements.
He highlighted that the Majority Leader’s lawsuit was filed prematurely, before the Speaker’s pronouncement, invalidating the claim.
Amidu also accused the Court of procedural lapses, including failing to address jurisdictional challenges raised by the Speaker and improperly incorporating interlocutory materials into the main case.
Calling the decision an "advisory opinion" rather than a binding judgment, Amidu warned it undermines public trust in governance and called for a reset of the 8th Parliament.
